I know how to keep a box safe for Live, and I know what risks I took that could have lead to each of my bans. So I've no problem playing burnt games. I have my current box modded with the Kamikaze hack, iXtreme, CoolRunner and DemoN chips, and dual auto-switched internal HDDs, and have kept it unbanned in this state for years. Since I've no experience with modding and updating and I wasn't there when they had the modded, I couldn't say if it really takes that long to just update and do whatever they needed to do to get it done.
